Interim Measures for the new regulatory power connected to the grid
Chapter I General Provisions

新建电源接入电网监管暂行办法
第一章 总 则
第一条 为了规范新建(包括扩建、改建,以下统称新建)电源接入电网系统工作,确保新建电源公平无歧视接入电网,根据《电力监管条例》等国家有关法律、法规,制定本办法。
第二条 本办法适用于省级及以上投资主管部门核准(包括“备案”)的新建电源项目(含并网发电机组的水利工程和航电枢纽的水力发电机组)接入电网监管工作。
新建电源接入电网监管包括对新建电源项目接入电网相关工作制度备案、接入电网服务、新建电源项目及配套送出工程(也称“接入系统工程”或“接入电网工程”)同步建设情况和相关信息公开情况的监管。
第三条 国家能源局及其派出机构对新建电源项目接入电网实施监管。
第四条 新建电源项目接入电网监管工作应当依法开展,并遵循公开、公正和效率的原则。
第五条 任何单位和个人对违反本办法的行为有权向国家能源局及其派出机构投诉和举报,国家能源局及其派出机构应当依法处理。
第二章 监管内容
第六条 国家能源局及其派出机构对协商接入电网的新建电源项目的合规性实施监管。
向电网企业协商提出接入电网的新建电源项目,应列入政府能源主管部门批准的电力发展规划或专项规划,取得同意立项意见。
第七条 国家能源局及其派出机构对电网企业关于新建电源项目接入电网工作制度及其备案情况实施监管。
电网企业应建立新建电源项目接入电网工作制度,明确办理接入系统服务的有关工作部门、工作流程、工作时限,以及新建电源项目配套送出工程建设有关工作部门、工作流程。
电网企业制订的新建电源项目接入电网工作制度应报所在地国家能源局派出机构备案。国家电网公司总部直接报国家能源局备案,南方电网公司总部同时报国家能源局备案。
第八条 国家能源局及其派出机构对电网企业向发电企业及其委托的设计单位提供新建电源项目接入系统设计资料情况实施监管。
发电企业须委托有资质、独立的设计单位开展新建电源项目接入系统设计工作。电网企业应按照相关行业标准,根据接入系统设计要求,及时向设计单位提供设计所需的电力系统相关资料,如因故确实不能及时提供的,电网企业应以书面形式告知发电企业,并予以说明。有关资料的获得、使用、保存和转移等环节应符合国家相关信息安全与保密的要求。
第九条 国家能源局及其派出机构对电网企业协商新建电源项目接入电网及出具书面答复情况实施监管。
发电企业完成新建电源项目接入系统设计相关工作后,应书面与电网企业协商接入事宜,并同时提交接入系统设计研究报告。电网企业应按照“公平、公开、高效”的原则,及时组织对新建电源项目接入系统报告进行研究,书面答复发电企业,并抄送所在地国家能源局派出机构。国家电网公司总部出具的接网答复直接抄送国家能源局,南方电网公司总部出具的接网答复同时抄送国家能源局。
电网企业对新建电源项目接入系统设计报告有不同意见的,应以书面形式对接入系统报告存在的问题一次性完整告知。发电企业应根据书面意见补充完善相关设计报告,并及时提交电网企业。
电网企业办理新建电源项目接入电网书面答复业务的期限应当符合下列规定:
自发电企业与电网企业协商提出新建电源项目接入电网之日起,电网企业组织研究并出具书面答复的期限:
1.国务院核准的新建核电项目不超过40个工作日;
2.国务院投资主管部门核准的新建燃煤(含低热值煤)、燃气等火电项目不超过40个工作日;主要流域上建设的水电站项目(含水利工程和航电枢纽的水力发电机组)不超过40个工作日;
3.省投资主管部门核准的新建燃煤背压热电、燃气热电、非主要流域上建设的水电站、风电站等电源项目不超过30个工作日;
4.新建并网光伏电站项目及分布式光伏发电项目按国家有关规定执行,其他分布式发电项目参照执行。
第十条 国家能源局及其派出机构对已商定的新建电源项目接网设计执行情况实施监管。
电网企业应根据商定意见,抓紧组织开展配套送出工程核准等前期工作。送出工程前期工作所需时间原则上不超过电网企业同电压等级、条件相近的其他电网工程,由各派出机构根据所在地实际情况提出时限要求。
因发电企业或电网企业单方面原因调整接网方案的,应商对方按照有关程序重新确定新的方案,相关费用由提出调整方承担。
第十一条 国家能源局及其派出机构按国家有关规定对新建电源项目配套送出工程投资界面实施监管。
第十二条 国家能源局及其派出机构对电网企业与发电企业签订接网协议书及其执行情况实施监管。
新建电源项目和送出工程均核准后30个工作日内,电网企业与发电企业应签订接网协议,并报送国家能源局及其派出机构备案。接网协议包括但不限于新建电源项目本期规模、开工时间、投产时间,配套送出工程投产时间,产权分界点,电力电量计量点,违约责任及赔偿标准等。其中,新建电源项目和送出工程建设周期原则上参考相关工程建设定额周期有关规定。
电网企业、发电企业应严格执行接网协议,相互配合,确保电源电网同步建成投产。因单方原因造成投产时间迟于接网协议约定时间并给对方造成损失的,违约方应根据约定标准向对方进行经济赔偿。
第十三条 国家能源局及其派出机构对新建电源项目接入电网信息公开情况实施监管。
电网企业和发电企业应对新建电源项目接入电网业务,建立健全信息公开制度和全过程规范管理的信息档案制度,真实、准确、全面记录新建电源项目接入电网的有关信息。
电网企业应通过门户网站公开新建电源接入电网相关工作制度,为发电企业查询新建电源项目接入系统设计报告评审进度提供便利,并每季度向申请接入电网的发电企业通报截止到上季度末的下列信息:
(一)当期发电企业书面协商接入的项目列表(配套送出工程未投产),配套送出工程前期工作进展情况,各项目发电企业书面协商接入时间、电网企业书面答复时间;
(二)该新建电源项目配套电网工程项目概况、计划及工程建设进度;
(三)与该新建电源项目接入电网相关的其他信息。
发电企业应在每季度向电网企业通报截止到上季度末的下列信息:
新建电源项目前期工作进展、建设阶段性进度情况。
第十四条 任何单位在办理新建电源项目接入电网业务时不得对工程项目提出指定设计单位、工程施工单位、设备材料供应单位等不正当要求。
第三章 监管措施
第十五条 国家能源局及其派出机构应根据工作需要定期对新建电源接入电网情况进行监管评价。
第十六条 国家能源局及其派出机构依法履行职责,对新建电源项目接入电网工作情况及投诉举报情况开展检查,可以采取下列措施:
(一)进入电网企业、发电企业以及项目施工现场进行检查;
(二)询问电网企业、发电企业的工作人员,要求其对相关检查事项做出说明;
(三)查阅、复制与检查事项有关的文件及资料,对可能转移、隐匿、损毁的文件及资料予以封存;
(四)对检查中发现的违法违规行为,依法进行处理。
第十七条 发电企业和电网企业对新建电源项目接入电网工作有争议的,按照《电力并网互联争议处理规定》处理。
第十八条 发电企业和电网企业违反本办法规定,国家能源局及其派出机构依据有关法律、行政法规和《电力监管条例》及其有关监管规则依法进行处理。
第十九条 国家能源局及其派出机构可将电力企业违反本办法的行为及其处理情况向社会公布。
第四章 附 则
第二十条 国家能源局派出机构可参照本办法制定相应的实施细则。
第二十一条 省以下政府投资主管部门核准的新建电源项目参照本办法执行。
第二十二条 本办法由国家能源局负责解释。
第二十三条 本办法自2014年4月1日起施行,有效期为3年。
