THE REGISTRATION
OF ENERGY
SERVICE SERVICE COMPANY (ESCO)

1. INTRODUCTION
In improving the energy efficiency in government buildings, the government has approved the implementation of Energy Performance Contracting (EPC) concept. The EPC concept has proven to be effective and successful in other countries such as Singapore, Thailand and the United States. The implementation of energy efficiency initiatives through the EPC concept will be implemented by Energy Service Companies (ESCO) and will not involve financial investment from the government and all the savings gained after the contract ends will accrue solely to the owner of the buildings. It is a public-private partnership where the up-front capital costs will be borne entirely by the ESCOs.
In ensuring successful implementation of energy efficiency improvement projects based on the EPC concept for government buildings, ESCOs are required to register with the Ministry of Finance to enable them to carry out the EPC activities involving government buildings under the Green Technology Services Code (222801). The Ministry of Finance requires that ESCOs applying for registration under this Green Technology Services Code be registered with the Energy Commission as an ESCO.
Under the Green Technology Services Code (222801), registration of ESCOs is required for the following scope of work:
i) Supply of energy efficient devices and equipments
ii) Consultancy Services
iii) Contract Works
iv) Energy Audit
v) Design Engineering
vi) Project Financing
vii) Management of EPC Contract
viii) Commissioning and Services
ix) The operation and maintenance of equipment energy-efficient installation and;
x) Inspection of energy efficiency improvement projects
The EPC implementation will offert e government the following benefits:
i) Savings in terms of inVestmeht in identifying and Implementing energy saving measures in government buildings;
ii) Annual electricity bill savings and guaranteed eneigy savings targets;
iii) Improve the competency of efficient energy management among the owners of government buildings;
iv) To drive the energy efficiency services industry to be more viable in the future with the participation the ESCO, and;
v) To ensure a more comprehensive building maintenance in achieving.

2. REQUIREMENT AND CRITERIA FOR REGISTRATION OF ESCO
For the purposes of registration of ESCOs with the Energy Commission, the list of requirements and criteria to be fulfilled by the applicants are as follows:
i) The applicant has registered his business with either the Registrar of Business or the Registrar of Companies as the case may be;
ii) The applicant has employed, on a full time basis, a Registered Electrical Energy Manager as prescribed under the Efficient Management of Electrical Energy Regulations 2008;
iii) The applicant has access to suitable monitoring and testing equipment and instruments required for energy efficiency management works (as stated in the application form);
iv) The applicant has satisfactorily furnished all the information as stipulated in the application form.
The Certificate of Registration as an ESCO may not be transferred •unless with the written approval of the Energy Commission.
Any change of name, address and other details of the business or company stated in the Certificate of Registration must be informed in writing to the Energy Commission within 14 days of such change.
In the event of any change or replacement of an appointed Registered Electrical Energy Manager, the ESCO shall ensure that a new Registered Electrical Energy Manager be appointed to effect such change or replacement and the ESCO shall notify in writing to Energy Commission within 14 days of such change or replacement.
All electrical work in relation to the Energy Services provided by the Registered ESCO must be performed by Competent Persons in accordance with the Electricity Supply Act 1990 and the Electricity Regulations 1994.
3. VALIDITY PERIOD OF CERTIFICATE OF REGISTRATION
The Certificate of Registrationissued under this guideline is only valid fora period of one (1 ) year from the date of issuance of the said.Certificate of Registration.
4. RENEWAL OF CERTIFICATE OF REGISTRATION
The renewal of the Certificate of Registration as an ESCO must be made not less than one (1 ) month before the dat of expiry of the registration.
5. CANCELLATION OF CERTIFICATE OF REGISTRATION
The Energy Commission may cancel the Certificate of Registration as an ESCO if:
i) The holder of the Certificate ceases to carry on the business in respect of which he is registered; ii) The holder of the Certificate has been adjudicated a bankrupt; iii) The company goes into liquidation.
6. RETURN OF CERTIFICATE OF REGISTRATION
Where a Certificate of Registration as an ESCO is cancelled by the Energy Commission, the Certificate must be returned to the Energy Commission within fourteen days of the notification of the cancellation.
7. SUBMISSION OF APPLICATION
The completed application form together with all the supporting documents and an application letters must be submitted to the Director of Energy Management and Industry Development, Energy Commission at the following address:
